Qualifying for Summary Dissolution

Summary dissolution of marriage can save both parties a significant amount of time, expense, and stress when compared to the traditional dissolution process. However, California family courts have strict guidelines for who can utilize the summary dissolution process.

A couple is only eligible to file for a summary dissolution of marriage if they meet all of the following criteria:

  • Both spouses have agreed to separate
  • The couple has been married for less than five years
  • There are no children of the marriage (and the wife is not currently pregnant)
  • The parties do not own any real estate
  • Neither party owes more than $6,000 in debt acquired during the marriage (excluding auto loans)
  • Neither party has more than $41,000 in assets acquired during the marriage or $41,000 in assets acquired before the marriage (excluding cars)
  • Both parties agree that neither will receive spousal support (alimony)
  • The parties have agreed upon a full division of their property and debts

Summary dissolution of marriage may be an appealing option for couples who meet the above criteria and who are already in agreement on all the major issues in their divorce. Because parties to a summary dissolution do not have contested issues to resolve, there are no hearings before a judge. Therefore, couples who are eligible for summary dissolution can bypass the time-consuming and often contentious court process. However, the six-month “cooling off” period imposed on all California divorces still applies to the parties involved in a summary dissolution proceeding.
