Domestic Violence Restraining Orders

A domestic violence restraining order (DVRO) protects a person from an abuser with whom they share an intimate relationship. This could be a spouse, domestic partner, boyfriend/girlfriend, or roommate. DVROs also cover those who are closely related including parents, siblings, grandparents, and/or children.

When you obtain a domestic violence restraining order against someone, the DVRO can compel the restrained person to cease contact and stay away from you, your family, your home, and your workplace. A DVRO can also compel someone to pay child support, spousal support, and even certain bills.

DVROs may prevent the abuser from:

  • Seeing his/her children
  • Going to certain places
  • Owning a gun
  • Living in their place of residence

If you are involved in a situation where you believe a DVRO is necessary, you should act quickly. Our Los Angeles divorce attorneys can help you seek a DVRO to protect yourself and your loved ones.

Civil Harassment Restraining Orders

Civil harassment is a type of harassing conduct committed by one party when that party is not closely related to or involved in a current (or prior) romantic relationship to the other party.

These relationships include:

  • Non-immediate family members such as cousins, aunts, and uncles
  • Neighbors
  • Friends
  • Strangers

If you feel threatened by someone’s harassment, you may file for a civil harassment restraining order to protect yourself.

There are multiple types of civil harassment restraining orders that work to provide a party with protection:

  • Emergency protective orders: Restraining orders that only police officers can request
  • Temporary restraining orders: Restraining orders given by a judge when a party goes to court to request the restraining order; these are usually valid for 20-25 days and a party must then go back to court to extend it
  • Criminal protective orders (or stay-away orders): Given when the abuse or harassment is so severe that the District Attorney files criminal charges; the criminal protection order is valid the entire time a criminal case is ongoing
